MEMBER ASSUMPTION OF RISK AND RELEASE 

I understand the risk of injury from CLUB activities and using any CLUB equipment is significant, including the potential for permanent paralysis and death, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown. I acknowledge that this is an UNSUPERVISED FITNESS CENTER and I assume all risks associated with using exercise equipment and other products and machines, attending and participating in instructor led classes, and exercising alone without the aid and presence of CLUB staff on the premises. In addition, I acknowledge that club activities may include outdoor activities which may present additional risks, such as slippery surfaces, uneven surfaces, loose rock or gravel, and unseen roots and other items.  

I HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS Pink Iron Fitness, LLC and its affiliates, as well as all sponsors and advertisers, and all owners and lessors of the premises of such clubs, and their respective officers, affiliates, agents and employees WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, LOSS OR DAMAGE to person or property that may arise out of or in connection with my use of any of the equipment products and machines or the facilities of the CLUB, or any indoor or outdoor exercise program offered at or by the CLUB, or of any other club associated with Pink Iron Fitness, LLC, or any incident that occurs while using such facilities, or otherwise related to my membership. 

I expressly agree that this release is intended to be as broad and inclusive as permitted by applicable law and if a portion of this release is held invalid, the balance shall remain in full force and effect. This release shall apply to my heirs, assigns, personal representatives and any other next of kin. I understand that the CLUB is relying on this release in agreeing to enter into this Agreement. 

I HAVE READ THE RELEASE OF LIABILITY AND ASSUMPTIONS OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS AND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. 

Photos/Video .  The undersigned agrees to grant permission to Pink Iron to photograph and/or take video of the image, likeness, or depiction of the undersigned for use of fundraising, advertising, publicity, or any other purpose, including but not limited to marketing efforts, on behalf of Pink Iron and in any medium. The undersigned further grants permission to Pink Iron to edit, crop, or retouch such photographs and/or video, and waive any right to inspect the final photographs and/or video. The undersigned further waives any claim for compensation and hereby fully and forever discharges and releases Pink Iron from any claim for damages of any kind arising out of the use or publication of photographs or videos. Additionally, all rights to royalties or other compensation arising or related to use of any photograph or video are waived by the undersigned. Failure from the undersigned to notify Pink Iron of an issue with being photographed or recorded within ten (10) days of signing this agreement shall constitute an automatic agreement of this clause and the undersigned foregoes any claim against Pink Iron, its employees, agents, or assigns, related to the use or distribution of the aforementioned photographs and/or videos.
